Holding Schools & Day Care Centers Accountable

In Florida, schools and day care centers are legally required to act in loco parentis, meaning “in the place of the parent.” This means they are responsible for taking reasonable steps to protect children in their care.

  • Unsupervised sports activities: Schools have a responsibility to supervise children during gym class and at other times when they are playing sports. That responsibility includes providing the appropriate level of spotting or other direct protection.
  • Dangerous behavior during recess: Children often behave in ways that endanger themselves and others during recess breaks. Schools are expected to provide enough supervision to stop bullying and other dangerous behavior before it gets out of hand.
  • Sexual abuse by school personnel: Schools and day cares have a serious duty to keep children safe from sexual abuse by conducting careful background checks during the hiring process and continuing to supervise staff members once they are hired.
